1. About these terms
These terms apply to the Hubb mobile app for Android and iOS (the “App”), and the portal, mobile site, forms and links at hubb.software (together with the App, “Hubb”). By signing in to or using Hubb you agree to them. If you do not agree, do not use Hubb.
Hubb is provided by Hubb Engineering Services Ltd (“we”, “us”), company number 12713033, registered in England and Wales, VAT number 362265404, registered office Bourne House, Godstone Road, Whyteleafe, England, CR3 0BL.
It is developed and maintained for us by Unibuild Technologies Limited (“Unibuild”), company number 17055126, registered in England and Wales, registered office 12 Old Bond Street, London, England, W1S 4PW.
2. Who may use Hubb
Hubb is a workplace system for our staff and for subcontractors, clients and others we authorise. It is not a consumer service. You may use a signed-in area only if we have approved your account. Asking for an account does not guarantee one.
You must be at least 16, and you may use Hubb only for work connected with us. You may use public forms or links only for the purpose they were given to you.
3. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to use Hubb, including installing the App on devices you own or control, only for its intended work purposes while you are authorised to do so and in line with these terms. Hubb is licensed, not sold. There is no charge to you for using it, although your mobile provider may charge for data.
4. Your account
- Give accurate details, and let us know if they change.
- Keep your password and PIN private. Do not share your account or let anyone else clock, sign or submit records as you.
- Use a device with a screen lock and up-to-date software, and sign out if you stop using it or pass it on.
- Tell us straight away if your phone is lost or stolen, or if you think someone else has used your account.
You are responsible for activity on your account unless it happened through no fault of yours.
5. Keeping records accurate
Hubb holds records that affect pay, safety and legal compliance. You must enter information honestly and accurately, including clock times, your location, inspection and test results, and reports. Do not clock on or off for another person, tamper with your position or a device’s time, or sign for something you did not do, see or check.
Misuse may result in your access being removed. If you work for us or for a subcontractor, it may also be dealt with under the relevant disciplinary or contract terms, and false safety or compliance records may be reported where the law requires it.
6. Acceptable use
You must not:
- use Hubb unlawfully, or to harass, threaten or discriminate against anyone
- upload anything offensive, unlawful, or that you have no right to share
- access data or areas you are not authorised to see, or share information from Hubb except as your work requires
- copy, modify, reverse engineer or decompile Hubb, except where the law allows this and it cannot be excluded
- probe, overload or interfere with Hubb or its security, or introduce malware
- scrape Hubb or extract data by automated means
- sell, rent or give access to Hubb to anyone else
7. Content you add
“Content” means the text, photos, videos, signatures, documents and other material you add to Hubb. Content added for work forms part of our business records. As between you and us, we may keep, use, copy and share it for running our business, meeting our legal and contract duties and dealing with clients, regulators and insurers. If you own rights in Content, you give us a worldwide, royalty-free, continuing licence to use it for these purposes, including allowing Unibuild and our providers to process it for us. This does not change who owns material under your employment or engagement.
You confirm that you are entitled to add your Content. When taking photos or recording details, take only what is needed for the work, respect people’s privacy, particularly in residents’ homes, and follow our site and data protection instructions.
We may remove or correct Content that breaks these terms or is inaccurate, while keeping an audit copy where we need to.
8. Electronic signatures
Signing on screen, ticking a declaration or confirming a record in Hubb is intended to have the same effect as a handwritten signature, to the extent the law allows. Read what you are signing first. Hubb may record the time, device and your details with the signature as evidence.
9. Safety
- Do not use Hubb while driving or operating plant or machinery, or anywhere that using a phone would be unsafe or breach site rules.
- In an emergency, call 999. Hubb is not an emergency service, and a report or alert in Hubb does not replace raising an alarm or telling the right person directly.
- Hubb supports, and does not replace, your training, competence and judgement, or anyone’s legal health and safety duties. Stop and ask if something on site differs from what Hubb shows.
- Information, including drawings and risk assessments, may have changed or may not have reached your phone. Check you have the current version where it matters.
- Reporting in Hubb does not take away any duty to report matters in the other ways the law or your employer requires.
10. Privacy
Our Privacy Policy explains how we use personal data, including location data and phone permissions, and how to ask for your account to be deleted.
11. Availability and updates
We aim to keep Hubb available and working properly, but cannot promise it will always be uninterrupted or free of faults. We may need to suspend it for maintenance, security or reasons beyond our control. Some features need a signal. Items saved on your phone without a signal are sent when a connection returns, and could be lost if the App is removed or you sign out before then.
We may change, add or remove features. We may release updates, and may require you to install one to keep using the App. Your use of a new version is covered by these terms. You are responsible for your own device, data connection and permissions unless your employer provides them.
12. Third-party services
Hubb can link to or depend on services run by others, such as Google Maps for directions, and your phone’s own camera, speech recognition and notification services. Those providers’ own terms and policies apply, and we are not responsible for their services.
13. Intellectual property
Hubb, including its software, design, text and graphics, belongs to Unibuild, us or our licensors. The Hubb name and logos belong to us. Apart from the licence in section 3 and your rights in your Content, these terms give you no rights in them. Third-party open source components are subject to their own licences.
14. Suspending or ending access
We may suspend or end your access at any time, including when your work with us ends, if your role changes, if you break these terms, or to protect people, data or the system. App sign-ins also end after 90 days without use. You can stop using Hubb at any time and ask us to delete your account as set out in the Privacy Policy.
When access ends, your licence ends, and you must stop using Hubb and remove the App from devices unless you are told otherwise. We keep records as described in the Privacy Policy. Sections that are meant to continue, including those on Content, intellectual property, liability and general terms, stay in force.
15. Our liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be limited or excluded. Nothing affects your statutory rights, including your rights as a worker or as a consumer where those apply.
Subject to that, Hubb is provided free of charge to help with work, and to the extent the law allows:
- we exclude warranties and conditions that are not set out in these terms
- we and Unibuild are not liable for loss of profit, business, contracts or goodwill, or for indirect or consequential loss arising from your use of Hubb
- we are not liable for loss caused by events outside our reasonable control, or by your failure to follow these terms
Any contract between us and a client or subcontractor sets out the liability between those parties, and prevails over this section as between them.
16. Your employment or engagement
These terms govern your use of Hubb only. They are not a contract of employment and do not change your employment contract, subcontract or statutory rights. If they conflict with one of those contracts about anything other than use of Hubb, that contract prevails. Having an account does not create employment or engagement, or any promise of work.
17. Terms for Apple devices
These terms apply if you got the App from Apple’s App Store. In this section, the “App Provider” is Hubb Engineering Services Ltd, and Unibuild Technologies Limited as well where it is named as the seller on the App Store.
- Acknowledgement. These terms are between you and the App Provider, not Apple. The App Provider, not Apple, is solely responsible for the App and its content.
- Scope of licence. Your licence is a non-transferable licence to use the App on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. The App Provider alone is responsible for maintenance and support, as set out in these terms or as the law requires. Apple has no obligation to provide any maintenance or support for the App.
- Warranty. The App Provider is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to meet an applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the App. To the maximum extent the law permits, Apple has no other warranty obligation regarding the App. Any other claims, losses, liabilities, damages, costs or expenses from a failure to meet a warranty are the App Provider’s responsibility.
- Product claims. The App Provider, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, any claim that the App fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that the App or your possession and use of it infringes their intellectual property rights, the App Provider, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that you are not located in a country subject to a US Government embargo, or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Contact. Questions, complaints or claims about the App should go to Hubb Engineering Services Ltd, Bourne House, Godstone Road, Whyteleafe, England, CR3 0BL, hello@hubbengineeringservices.co.uk, 01883 621 080.
- Third-party terms. You must comply with any applicable third-party terms when using the App, such as your mobile data agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
18. Terms for Google Play
If you got the App from Google Play, these terms are between you and us, not Google. Your use of Google Play is also subject to Google’s own terms. Google is not responsible for the App or its content, or for supporting it.
19. General
- Changes. We may update these terms when Hubb, our business or the law changes. The current version is on this page with its date. We will tell you about significant changes in the App, in the portal or by email. If you keep using Hubb after a change takes effect, the updated terms apply. If you do not agree, stop using Hubb and contact us.
- Transfer. We may transfer our rights and duties under these terms to another organisation, such as a successor to our business. You may not transfer yours.
- Other people’s rights. Unibuild may rely on the sections that protect it, and Apple has the rights in section 17. Otherwise nobody other than you and us may enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
- Severance and waiver. If part of these terms is found to be unenforceable, the rest stays in force. If we delay enforcing a term, we can still enforce it later.
- Law and courts. These terms, and any dispute about them, are governed by the law of England and Wales, and its courts have jurisdiction. If you live elsewhere in the UK, you may also be able to bring proceedings in your local courts. Nothing here affects any right to bring a claim in an employment tribunal.
